Patient Rights & Responsibilities

Kerr Health Patients have the right to:
- Receive adequate service without discrimination toward race, creed, gender, age, handicap, sexual orientation, diagnosis, lifestyle, or source of payment;
- Receive information regarding Kerr Health’s ownership, available services, insurance coverage, and other applicable charges upon request;
- Be fully informed orally and/or in writing of the following before care is initiated, when and how services/products will be provided, the name and function of any person or agency providing services/products, the name of the person responsible for coordination of care and organization ownership and control;
- Participate in the development of the plan of care and any modification thereof, before it is made;
- Receive medical, nursing, therapeutic and personal care in accordance with the agreed plan of care;
- Be informed in advance, both orally and in writing, about the care to be furnished and of any changes in the care to be furnished, including the disciplines that will furnish care, any substitution of medications, and the frequency of services proposed;
- Be notified in advance of treatment options, transfers, when and why care will be discontinued;
- Receive education, instructions and requirements for continuing care when services are discontinued;
- Make informed decisions about care and treatment plans and to receive information in a way that is understandable;
- Choose whether or not to participate in research, investigational or experimental studies or clinical trials after receiving a full understanding of information explained;
- Participate in the selection of options to alternative levels of care or referral to other organizations;
- Refuse treatment or withdraw consent for treatment and be informed of results and/or risks;
- Confidentiality of the clinical and financial records (in accordance with state and federal law) and be informed of Kerr Health’s Policies and Procedures regarding disclosure of the clinical record;
- Exercise civil rights and religious liberties, including the right to submit grievances to the agency and to be free from restraint, interference, coercion, discrimination, or reprisal;
- Be treated with consideration, respect and full recognition of the patient’s dignity and individuality, including privacy in treatment and personal care needs;
- Be free from any mental abuse, physical abuse, neglect, or exploitation of any kind from Kerr Health staff;
- Be informed, before care is initiated, and prior to a change of rates, charges or services, to the extent to which payment for agency services may be expected from Medicare or other third party sources, and the extent to which payment may be required from the patient;
- Be informed orally and in writing of the following as soon as possible, but no later than 15 calendar days from the date the agency became aware of the change; billing policies; payment policies; any changes in the information provided on admission; and termination of services;
- Have the family or the patient’s representative exercise the patient’s rights when the patient has been judged incompetent;
- Receive services without regard to whether or not advance directives have been executed;
- Communicate with Kerr Health associate assigned to patient’s account and have supervisor assistance if necessary;
- Communicate concerns verbally and in writing regarding treatment or care to the Specialty Pharmacy line (toll free)at 866-443-1904, 24 hours/7 days a week;

After Hours On-call Clinical Staff (press 9)
9am-5:30pm Monday – Friday
- Receive any relevant information on orders by calling the number above;
- Receive instructions on how to access drugs if emergency, disaster, or delay occurs by calling Kerr Health Specialty Pharmacy;
- Receive instructions on how to address adverse drug reactions by calling Kerr Health Specialty Pharmacy;
- Receive and access services consistently and in a timely manner in accordance with company stated policies;
- Expect that the company will investigate complaints made by a patient or patient’s representative and that the existence of the complaint and the resolution of the complaint be documented;
- Receive information on advanced directives including a description of the individual’s rights under state law and how such rights are implemented by the company;
- Receive information on handling any drug recall, compliant with manufacturer guidelines;
- Be referred to another provider if the company is unable to meet the patient’s needs or if the patient is not satisfied with the care that they are receiving.
Kerr Health Patient’s are required to:
- Provide Kerr Health with a complete and accurate health history, including all requested clinical information;
- Provide Kerr Health with all requested insurance and financial information, while ensuring accuracy, in order to fulfill financial obligations for agreed services;
- Provide accurate clinical information and personal contact information and notify Kerr Health of any changes;
- Provide Kerr Health with a written prescription in order to receive medications – by 3pm in order to receive same-day service;
- Sign the required consents and releases for insurance billing;
- Remain under a doctor’s care while receiving Kerr Health’s services;
- Strictly abide by agreed plan of care and clinical condition;
- Actively participate by helping develop/update plan of care, asking questions and expressing concerns;
- Communicate an understanding of agreed course of treatment and plan of care;
- Cooperate with your doctor, our staff, and other caregivers;
- Report unexpected changes in your condition, hospitalizations, problems/concerns/complaints to the clinicians/agencies responsible for your care;
- Accept responsibility for any refusal of treatment or failure to follow a plan of care;
- Abide by company’s policies, which restrict duties our staff may perform;
- Advise the company’s administration of any dissatisfaction or problems with your care;
- Notify your treating provider of all services being provided to you through Kerr Health;
- Notify your doctor, our staff, and other caregivers if services are no longer being provided by Kerr Health;
- Dispose of unused, unwanted or discontinued medications in a lawful and confidential manner. Injectable medications including syringes and needles should be placed in the provided sharps container after use;
